End User License Agreement

End User License Agreement (EULA) – DNS Explorer by DNSai LLC

This End User License Agreement ("EULA") is a legally binding agreement between you (the "User") and DNSai LLC, a company duly organized and existing under the laws of the United States, with its principal place of business located in Utah ("DNSai LLC"). DNSai LLC provides services existing online through various virtual mediums providing SaaS applications, website services, and install-based applications. This EULA governs the use of DNS Explorer, a software application developed by DNSai LLC.

Welcome to DNSai, a DNS utility and security information service operated by DNSai LLC. These Terms of Use apply to DNSai services available at dnsai.com and to DNSai software and tools, including the downloadable desktop application DNS Explorer provided by DNSai LLC. DNSai services are accessible via modern web browsers on a wide range of operating systems (including macOS, Windows, Linux, and other contemporary platforms), and DNS Explorer is designed to run on these platforms subject to system requirements.

1. Acceptance of Terms & License Grant

By accessing or using DNSai services or tools (including DNS Explorer), you confirm that you have read, understood, and agree to these Terms of Use. If you do not agree with any part of these terms, do not use DNSai services or tools.

Subject to your compliance with the terms of this EULA, DNSai LLC grants you a personal, non-exclusive, non-transferable, and revocable license to use DNS Explorer on macOS, Windows 10, Windows 11, and various Linux distributions.

2. Authorized Use & Use Restrictions

DNSai must be used only for lawful and ethical purposes. You agree not to use DNSai to violate any applicable law or regulation, or to engage in activities such as unauthorized access, disruption, scraping contrary to site terms, spamming, phishing, or other malicious conduct.

Intellectual Property: You agree that DNS Explorer, including its code, design, and all related materials, is the intellectual property of DNSai LLC. You shall not, under any circumstances, attempt to reverse engineer, decompile, disassemble, or create derivative works from DNS Explorer.

Distribution: You shall not distribute, sublicense, rent, lease, or otherwise transfer DNS Explorer or any portion thereof to any third party without the prior written consent of DNSai LLC.

3. Payment and Refunds

Payment: In consideration for the license granted herein, you agree to pay the applicable license fee for DNS Explorer.

Refunds: No refunds are guaranteed. DNSai LLC understands that sometimes issues arise, and customer satisfaction is important to us. Paid customers of DNS Explorer may request a refund within 7 days of the initial subscription purchase or subscription renewal. DNSai LLC does not guarantee refunds and at the purchase page, it is disclosed that DNSai LLC has a no refund policy for DNS Explorer subscriptions. If a refund is considered, refunds will be granted at the sole discretion of DNSai LLC.

4. Transparent Data Collection & Commercialization Disclosure

By choosing to use DNSai services or tools (including DNS Explorer), you acknowledge and agree that DNSai LLC may collect, store, process, commercialize, and/or sell data that you input into, upload to, or generate through the services and tools, as well as technical and usage data related to your access and use. This is a core aspect of DNSai's business model and is disclosed here transparently.

4.1 Categories of Data: Depending on how you use DNSai, the following categories of data may be collected: (a) information you submit (e.g., domains, emails, queries, labels, notes); (b) usage/telemetry (e.g., timestamps, feature interactions, device/browser information, IP addresses); (c) derived or aggregated insights generated by our systems from your inputs and usage.

4.2 Uses of Data: DNSai LLC may use collected data to operate and improve services, provide support, train and evaluate models, perform analytics, develop new products, conduct security and abuse prevention, market and sell products, and otherwise pursue legitimate business interests consistent with applicable law.

4.3 Sharing, Licensing, and Sale: DNSai LLC may share, license, or sell collected or processed data (including with partners, affiliates, service providers, and third-party data brokers). Where personal data is involved, DNSai LLC will handle such data in accordance with applicable law and our Privacy Policy. Data may be de-identified, aggregated, or otherwise transformed prior to sharing or sale, where required or appropriate.

4.4 Your Choices & Legal Rights: If you do not want your data to be collected, stored, used, or sold as described, do not use DNSai services or tools. Where applicable law provides rights (e.g., access, deletion, correction, portability, objection, restriction, or opt-out of "sale"/"sharing"), DNSai LLC will honor those rights as described in the Privacy Policy. If your jurisdiction requires consent for certain processing or sale, DNSai will obtain such consent where required and provide mechanisms to withdraw consent when available.

4.5 Data Retention & Security: DNSai LLC retains data for as long as necessary to fulfill the purposes described here and in the Privacy Policy, unless a longer period is required or permitted by law. We apply industry-standard administrative, technical, and organizational measures intended to protect data from unauthorized access, disclosure, alteration, or destruction.

5. User Responsibilities

You are solely responsible for your inputs, configurations, and how you use any information obtained via DNSai. You agree to comply with all applicable laws and third-party rights. DNSai LLC is not responsible for misuse or for actions you take based on information produced by the services or tools.

5.1 Consent to Data Practices: By using DNSai, you consent to the collection, use, sharing, licensing, and sale of data as described in these Terms and in the Privacy Policy, subject to your rights under applicable law.

5.2 Exercising Rights: To exercise rights available in your jurisdiction (for example, to request access or deletion or to opt-out of sale/sharing where applicable), follow the instructions in the Privacy Policy or contact us using the methods provided there.

6. Termination

This EULA is effective until terminated. DNSai LLC reserves the right to terminate this license at any time without notice if you breach any of its provisions. DNSai LLC may suspend or terminate access to DNSai services or tools at any time and for any reason, including violations of these Terms. Upon termination, you must immediately cease using DNS Explorer, uninstall the software, and destroy all copies of the software in your possession.

7. Warranty Disclaimer

DNS Explorer and DNSai services are provided "AS IS" and "AS AVAILABLE," without any warranty, express or implied. To the maximum extent permitted by applicable law, DNSai LLC makes no representations or warranties regarding the accuracy, reliability, or suitability of the software or services for any particular purpose, including warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, and availability. You assume full responsibility for the selection and use of DNS Explorer and DNSai services.

8. Limitation of Liability

To the maximum extent permitted by applicable law, DNSai LLC and its affiliates, officers, employees, and agents shall not be liable for any indirect, special, incidental, consequential, exemplary, or punitive damages; loss of data; loss of profits; business interruption; or costs of substitute services arising out of or in connection with the use of DNS Explorer or DNSai services, even if advised of the possibility of such damages. In no event shall DNSai LLC's total liability exceed the amount paid by you for the software or service giving rise to the claim during the twelve (12) months preceding the event.

9. Updates and Modifications

DNSai LLC may, at its sole discretion, provide updates, modifications, or new versions of DNS Explorer or modify or discontinue features at any time. You agree that such updates and modifications may be subject to additional terms and conditions, and you consent to their installation. We may update these Terms from time to time. Material changes will be effective as stated in the updated Terms. Your continued use after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

This EULA and these Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law principles. Exclusive jurisdiction and venue for any dispute arising from or relating to this EULA, these Terms, or DNSai shall lie in the state or federal courts located in Utah.

11. Entire Agreement

This EULA constitutes the entire agreement between you and DNSai LLC regarding the use of DNS Explorer and supersedes all prior or contemporaneous understandings and agreements, whether oral or written.
